PHEAA $33,000 Halftime Kick Contest 

Official Promotion Rules

 

THERE IS NO PURCHASE NECESSARY TO ENTER OR TO WIN.

 

1) Description of the Promotion: Pennsylvania Higher Education Assistance Agency (the “Sponsor”), is offering the “PHEAA $33,000 Halftime Kick Contest”, (the “Promotion”) and will make a series of random selections from valid entrants to determine one Final Field Goal Kick Competitor (“Final Kick Competitor”). The Final Kick Competitor will have the opportunity to attempt to make a successful field goal kick as defined by the Field Goal Kick Competition Rules (See Section 7), conducted at the half-time festivities of the PNC Big 33 Football Classic, June 16, 2007, Hershey, PA, (“Big 33 Football Game”).

 

2) Eligibility:  The Promotion is open only to legal PA and OH state residents, who are currently enrolled in an institution of higher learning or technical school in OH or PA and 2007 graduating high school seniors from public or accredited private schools in PA or OH and who plan to continue their education in an accredited institution of higher learning or technical school.

The following categories of individuals are NOT eligible:

(a)                 Current or former professional or semi-professional soccer, rugby or football player and coaches.

(b)                 Anyone who has played or coached high school or collegiate football, rugby or soccer at any level (freshman, junior varsity or varsity in men’s or women’s competition) or has played on or coached an international soccer, rugby or football team in the past five (5) years. 

(c)                 Employees, officers, representatives, agents, successors or assignees of Pennsylvania Higher Education Assistance Agency, (“PHEAA”) and the Big 33 Scholarship Foundation, their affiliated organizations and companies, advertising and promotion agencies and any company involved in the design, execution or production of the promotion are not eligible

 

This Promotion is void where prohibited or restricted by law. 

 

3) Contest Contestants:  There will be twenty-one (21) Contestants and (5) Alternate Contestants randomly selected who will be invited to attend the Big 33 Football Game and participate in the half-time festivities where one (1) of the Contestants will be randomly selected at the Final Kick Competitor.  

 

4) How the Final Kick Competitor is determined. At the Big 33 Football Game, the twenty-one (21) Contestants will each be assigned a unique number which he/she will record on the back of his/her placard.  Each Contestant will place his/her placard (face/number down) on the field during half-time festivities.  A professional sky diver will make a jump over the football field at half-time and the Contestant’s placard which the sky diver randomly selects to land on or closest to, as determined by Contest Officials, will be determined as the Final Kick Competitor. In the event the participation of a skydiver is prevented for weather or for any other reason, the assigned numbers of the Contestants will be placed in a random drawing from which the one of the Contestants will be selected as the Final Kick Competitor.

The odds of being determined the Final Kick Competitor are 1:21.      

 

5) How to Enter for Chance to be a Contestant at the Big 33 Football Game: There are two (2) methods by which Contestants will be randomly selected.

On-line Entry – Visit www.pheaa.org between 12:01 AM April 23, 2007 Eastern Time (ET) and 11:59 PM June 2, 2007 (“On-Line Entry Period”) and complete the registration form with your first and last name, street address, city, state, zip code, telephone number, email address, your date of birth, the name of the post secondary school (college, university or technical school) you are currently attending or the name of the OH or PA high school at which you are currently a graduating senior and the name of the institution at which you plan on continuing your post secondary education. You will also be asked to verify that you have not played or coached high school or collegiate football, rugby or soccer at any level (freshman, junior varsity or varsity in men’s or women’s competition) or played on or coached an international soccer, rugby or football team in the past five (5) years.  You will also be given the opportunity to “opt in” to receive further electronic communication from PHEAA.  Opting to receive communication is not a requirement for valid entry nor does it increase your chances of winning. (Please see the link below to the PHEAA privacy policy.)  There is a limit of one (1) entry per person per email address. Ten (10) entrants will be randomly selected all eligible on-line entrants as Contestants to participate in the half-time festivities at the Big 33 Football Game.

 

The odds of being selected as one of the Contestants by entering on-line depend upon the number of eligible on-line entries received.

 

By Invitation at PHEAA Sponsored Luncheons  – Eligible individuals who have received a Big 33 scholarship and who are present at the Big 33 luncheons on April 2, 2007, April 9, 2007 and April 16, 2007 are automatically entered into the respective drawings, which will be held at each luncheon. One (1) Contestant will be randomly selected at the April 2 luncheon, five (5) Contestants at the April 9 luncheon and five (5) Contestants at the April 16 luncheon. The odds of being selected a Contestant at one of the luncheons depends on the number of attendees at each of the respective luncheons. 

 

Additionally, five (5) Alternate Contestants will be randomly selected at the Big 33 luncheons to attend the Big 33 Game.  Two (2) Alternate Contestants will be randomly selected at the April 9, 2007 luncheon, and three (3) Alternate Contestants will be randomly selected at the April 16, 2007 luncheon. 

 

An alternate Contestant will participate in the half-time festivities ONLY if needed as determined by Officials to replace one of the Contestants due to absence or disqualification. If needed for participation, a random drawing will be conducted from the five (5) Alternate Contestants to determine the one to be named as a Contestant. 

 

All Contestants and Alternate Contestants will be required to complete and return an Affidavit of Eligibility & Liability/Publicity Release (the “Affidavit”) (where legal) within five (5) calendar days of being provided the Affidavit. Failure to return the satisfactorily completed Affidavit within the stated time frame will result in disqualification and the selection of an alternate. 

 

6) Contestant Prize:  Each of the twenty-one (21) Contestants and the five (5) Alternate Contestants will receive three (3) tickets to the PNC Big 33 Football Classic, June 16, 2007, Hershey, PA and a $175 travel allowance to attend the game.  Approximate retail value $208. There are twenty-six (26) Contestant Prizes with a total value of $5,408. 

 

7) Field Goal Kick Competition Rules (“Kick Competition Rules”): The Field Goal Kick Competition (the “Competition”) will be officiated by three (3) Competition Officials (the “Officials”) selected by the Sponsor.  The Officials will certify they have supervised and conducted the Competition in accordance with the following Kick Competition Rules. 

 

The Field Goal Kick Competitor…

(a)                 Will not be permitted any practice, warm-up or pre-qualifying kicks.

(b)                 Will be permitted only ONE attempt to make the field goal kick.

(c)                 Must kick from an Official NFL one-inch (1”) kicking tee.

(d)                 If a male, must kick the football provided from a distance of not less than 40 yards (i.e. no closer than the 30-yard line).

(e)                 If a female, must kick the football provided from a distance of not less than 35 yards (i.e. no closer than the 25-yard line).

 

A successful kick (“Winning Kick”) will be defined as one in which the ball passes completely through the uprights of the goal posts “on the fly”, after leaving the Final Kick Competitor’s foot and prior to making contact with any surface or obstacle other than the goal itself.  Further, the Final Kick Competitor’s kick must be such as would otherwise qualify as a successful field goal from the specified distance under NFL rules.

 

Contest Officials reserve the right to disqualify ANY Contestant, including the Final Kick Competitor, prior to, during or subsequent to the kick, who they find, in their sole discretion to be acting in violation of the Kick Competition Rules; to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any person. 

 

The decision of the Contest Officials in all matters related to the Competition are final and subject only to review as to compliance with the Kick Competition Rules by McLarens Young International, an independent judging firm. 

 

8) Field Goal Kick Competition Prize:  If the Final Kick Competitor complies with all Promotion Rules and Kick Competition Rules and executes a winning   kick as defined by the Kick Competition Rules, he/she will be named the winner and will be awarded $33,000 in scholarship funds which will be (a) added to the winner’s Big 33 existing Scholarship Award (if the Final Kick Competitor received a Big 33 Scholarship Award) or (b) used to establish a Big 33 Scholarship Award for the winner.

 

If the Final Kick Competitor complies with all Promotion Rules and Kick Competition Rules, but fails to execute a winning kick as defined by the Kick Competition Rules, he/she will be awarded a consolation prize of $3,300 in scholarship funds which will be (a) added to the Final Kick Competitor’s Big 33 existing Scholarship Award (if the Final Kick Competitor received a Big 33 Scholarship Award) or (b) used to establish a Big 33 Scholarship Award for the Final Kick Competitor.  

 

The Sponsor will transmit the applicable scholarship funds directly to the Big 33 Scholarship Foundation, which will administer the funds in accordance with the guidelines established for the Big 33 Scholarship Program. If the Final Kick Competitor fails to comply with the requirements of the Big 33 Scholarship program, the entire Scholarship amount or any remaining portion of the Scholarship amount may be forfeited.  Any all taxes and income reporting associated with receiving any Scholarship Funds are the sole responsibility of the recipient. If the Final Kick Competitor is a minor, Scholarship Funds may be awarded in the name of his/her parent or legal guardian.

 

9) General: Contestants and Alternate Contestants will be contacted by phone and/or email on or about June 5, 2007 and will be required to complete, sign and return an Affidavit of Eligibility & Liability/Publicity Release (where legal). The Affidavit must be returned within five (5) calendar days of Sponsor’s provision of the Affidavit. Failure to return a satisfactorily completed Affidavit within the specified time period will in disqualification and selection of an alternate. If any Affidavit is s returned as undeliverable, the potential Contestant or Alternate Contestant will be disqualified and an alternate selected.

 

ANY AND ALL TAX LIABILITY RESULTING FROM AN INDIVIDUAL’S RECEIPT OF ANY PRIZE IS THE RESPONSIBILITY OF SUCH INDIVIDUAL. Scholarship funds are not redeemable for cash and there are no prize transfers or prize substitutions except at the sole discretion of the Sponsor.

 

In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder" person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in the Eligibility section of these official rules. "Authorized Holder" shall mean the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.

 

By entering, entrants (a) agree to comply with and be bound by the Official Promotion Rules, the Kick Competition Rules and the decisions of the Officials and the Sponsor which are final and binding in all respects; (b) agree to release Sponsor and its employees and agents from any and all liability, loss, damage or injury resulting from participation in this Promotion or from the awarding, receipt, possession use and/or misuse of any prize; (c) acknowledge that the Sponsor, and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (d) consent to use of his/her name, photograph and/or likeness, statements and voice for advertising and promotional purposes in all media worldwide and in perpetuity without additional compensation, unless prohibited by law; and e) understand that their sweepstakes registration information is being left at a 3rd party website provider to PHEAA and that the 3rd party website is governed by the PHEAA  privacy policy available at http://www.pheaa.org/about/Privacy_Policy.shtml.

 

Sponsor is not responsible for any lost, late, delayed, misdirected, garbled, illegible, incorrect or inaccurate information or entries that are misdirected or misrouted as a result of interrupted or unavailable network, phone or internet connections or transmissions for any reason, or for any computer, phone, phone line hardware or software malfunction, failure or error of any kind, whether mechanical, human or electronic. Any on-line entries received by using robotic, automatic, programmed or similar techniques are not eligible. Any attempt by an entrant to interfere with the operations of the Promotion is a violation of criminal and civil laws; Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.  If, for any reason, the on-line portion of the Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the on-line portion of the Promotion and to the extent feasible select Contestants and Alternate Contestants in a random drawing from among all eligible entries received prior to the cancellation. All entries are the property of the Sponsor. 

 

10) Release:  BY ENTERING THE PROMOTION, YOU RELEASE AND HOLD THE SPONSOR AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES OF SPONSOR AND ITS AFFILIATES, HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE PROMOTION OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR DEFECTS IN, A PRIZE, OR PARTICIPATION IN THE PROMOTION, INCLUDING WITHOUT LIMITATION CLAIMS BASED ON PERSONAL INJURY, DEATH, PROPERTY LOSS OR DAMAGE, PUBLICITY OR PRIVACY RIGHTS, AND/OR DEFAMATION.

11) Disputes: Except where prohibited, as a condition of participating in this Promotion, entrants (and their parents/legal guardians if entrants are minors) agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Promotion, or any prizes awarded, or the determination of Contestants, Alternate Contestants or Final Kick Competitor or winner shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering the Promotion) and entrant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Promotion Rules and the Kick Competition Rules or the rights and obligations of entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, U.S.A., without giving effect to the conflict of laws rules thereof, and all proceedings shall take place in the Commonwealth of Pennsylvania, County of Dauphin.

12) Cancellation/Force Majeure: If for any reason the Promotion is not capable of running as planned for any reason, including by reason of fraud, act of God, or any other factor beyond Sponsor's reasonable control, Sponsor reserves the right to cancel, terminate, modify or suspend the Promotion.  If the Contest is canceled, terminated, modified or suspended, Sponsor has no obligations to award any prizes and Sponsor’s only responsibility will be the timely notification of Contestants and Alternate Contestants. .

 

13) Contestant/Winners List: For a names of Contestants, Alternate Contestants and the Final Kick Competitor, send a self addressed stamped envelope for receipt no later than September 1, 2007 to: PHEAA $33,000 Field Goal Kick Contest Winner’s List, 1200 N. 7th Street, Harrisburg, PA 17102.
